The chronology of events surrounding a lost prototype iPhone 4 has led to the filing of criminal charges

The San Mateo County district attorney’s office has filed criminal charges against two men who obtained a prototype iPhone 4 last year and sold it to the gadget blog Gizmodo, CNET has learned.
Steve Wagstaffe, the district attorney, said in an interview today that his office has filed misdemeanor theft charges against Brian Hogan, the man who allegedly found the prototype in a bar after it was left there by an Apple engineer. An arraignment has been scheduled for August 25.
The second man charged is Sage Robert Wallower, who allegedly contacted technology sites last year while shopping around the iPhone 4 prototype. Wallower, a former Navy cryptologic technician who was scheduled to graduate from UC Berkeley in 2010, told CNET last year in an in-person interview at his home: “I didn’t see it or touch it in any manner. But I know who found it.”
Neither Gizmodo nor its parent company Gawker Media has been charged with any crime, Wagstaffe said. Nor have any of Gawker Media’s employees, including the editor whose home was raided by police armed with a search warrant.
Apple did not immediately respond to a request for comment this morning.
The investigation began early last year when Robert Gray Powell, a 28-year-old Apple computer engineer, left an unmarked prototype iPhone in a German beer garden in Redwood City, Calif. Hogan, who at the time was a 22-year old student, found the prototype and sold it to Gizmodo for $5,000.
Wagstaffe, who was elected district attorney in June 2010, said a few months ago that the investigation has taken so long because his colleagues have been busy on other cases. San Mateo County encompasses part of what’s commonly called Silicon Valley, with San Francisco to the north and Apple’s headquarters of Cupertino to the south in Santa Clara County.

Court documents unsealed last year at the request of CNET and other media organizations show that Apple pressed local police to investigate the loss of a next-generation iPhone a day after Gizmodo published photographs, telling investigators that the prototype was so valuable that a price could not be placed on it.
Apple CEO Steve Jobs introduced what became known as the iPhone 4 last June, and it appeared in stores later that month. (See our review.) Jobs was eventually interviewed as part of the investigation.
For over a year, speculation had centered on Hogan as the target of criminal charges based on a state law involving lost or stolen property. Under a California law dating back to 1872, any person who finds lost property and knows who the owner is likely to be–but “appropriates such property to his own use”–is guilty of theft. In addition, a second state law says any person who knowingly receives property that has been obtained illegally can be imprisoned for up to one year.
Convictions have resulted in cases that involved a person knowing that such an item probably belonged to someone else. “It is not necessary that the defendant be told directly that the property was stolen. Knowledge may be circumstantial and deductive,” a California appeals court has ruled. “Possession of stolen property, accompanied by an unsatisfactory explanation of the possession or by suspicious circumstances, will justify an inference that the property was received with knowledge it had been stolen.” State law says that lost property valued at $100 or more must be turned over to police.
Law enforcement officials previously indicated they were looking into the possibility of filing criminal charges against Gizmodo or Gawker Media.
One obstacle to pursuing criminal charges against a news organization are journalist protection laws. That’s what has been argued by the Reporters Committee for Freedom of the Press and like-minded advocacy groups, which say police violated the federal Privacy Protection Act, which broadly immunizes news organizations from searches — unless the journalists themselves committed the crime.
In addition, California law may provide protections to writers for newspapers, magazines, and “other periodical publications,” a term that a California court has applied to an Apple blog before.
But courts also have ruled that journalists suspected of criminal behavior do not benefit from the legal shields that newspapers and broadcast media have painstakingly erected over the last half-century. “It would be frivolous to assert–and no one does in these cases–that the First Amendment, in the interest of securing news or otherwise, confers a license on either the reporter or his news sources to violate valid criminal laws,” the U.S. Supreme Court has warned.

Pay attention to the terms of the free engraving such as forbidden words and phrases and character limits (number of letters, symbols, or numbers allowed). Keep in mind that this service is free but will add time to your estimated shipping time up to a few extra days to a few extra weeks.
If you forgot to get the device engraved online by Apple, you have another option. You can find a jeweler or electronics store that does custom laser engravings and have them engrave words on the back of your Apple device.
They must do laser engravings and not mechanical engravings which can damage the device. This will not be free and costs will vary depending on the device, the size of the engraving, and the person doing the engraving of the iPod or other device.
These are the only two options available for engraving your Apple product. Apple does not do in store engravings and Apple products bought from third party sellers can not be engraved by Apple. If you take your device to an Apple store or third party seller for engraving later on you will be turned away. You also can not return the device to Apple for engraving.
Remember to carefully choose your engraving as once you engrave an Apple product, Apple will not take the product back. Additionally, a personalized engraving can greatly decrease the resale value of your iPod, iPad, iPhone, or iPod Touch device.

It’s either one beaut’ of a marketing move or the kind of oops moment sure to make heads explode around the corporate offices of Apple.
Earlier today, Case-Mate briefly had up a web page featuring a new line of cases for Apple’s next iPhone, which, of course, has not yet been announced and thus officially does not exist for Apple. What was also on display was a device featuring a rounded aluminum backing, similar to that found in the iPad 2’s design.
But this is now one for the record books. In its place, the link points to a user sign up page to be notified when Case-Mate starts selling cases for the new device, whatever that may be.

Knitting as an art form has the capability to get you hooked on to the needles and yarn, making it a popular craft being practiced for centuries together. The time and energy spent in creating a particular piece of clothing speaks of the warmth, love, and concern of the individual and makes a perfect gift for someone you love. Considering this personal touch, it is no wonder why knitting is relatively very popular among expectant mothers and soon-to-be grandmothers.
The technique employed in knitting may seem complicated for an onlooker; however, once one gets the hang of twisting the needles right, he/she is sure to agree that this is one of the easiest crafts that can be pursued. That said, a first timer needs to know the basics of knitting, before which he/she needs to get the tools right. Take a look at what goes into the knitting basket.
One of the foremost essential requirements for knitting is good quality yarn. While it is good to work with soft yarn as a beginner, it would be best if you begin with a yarn that makes you comfortable to work with. Investing in cheaper varieties of yarn is a valid option, provided you are using it as a means to get used to the idea of knitting. Our advice: invest in a yarn that will make you smile as you work your way through the craft and continue to do so as you flaunt your handiwork.
As a beginner, it is best to stock up on the plain, basic yarn rather than the novelty yarn that is fancy and comes in different patterns. When you go out to purchase the yarn, remember to let your fingers do the walking, allow yourself to feel the yarn, and the one that you feel comfortable with is the one you should go ahead with.
You are sure to get confused with the variety of needles that are available for knitting. As a beginner, you can invest in a pair of single pointed needles in aluminum or plastic needles, depending on the size required for the particular project. Larger needles create large stitches, while fine needles create finer and closer knits. Similarly, knitting a shawl will require a longer needle, while a bootie requires a smaller needle.
It is better to invest in a needle kit which provides you with needles of different sizes, thus, allowing you to work on different projects as and when you feel the need to switch the knit style.
Commonly used for circular knitting, these needles come in handy while knitting sleeves, collars, hats, and socks. These needles are tapered at either end allowing them to be used both ways. These needles are generally shorter than the single point needles.
Circular needles are made by connecting two single point needles with a flexible cable or wire. Used for knitting circular pieces of fabric, these needles are simpler to use than the regular single point needles. These needles eliminate the need to switch from one needle to the next; besides, it nullifies the risk of stitches slipping from the tips of the needle. Another benefit of this needle is that it allows the woven fabric to rest in the lap of the knitter; it is less taxing as the weight is evenly distributed across the needle.
It is always better to keep a crochet hook handy while undertaking a knitting project. Apart from rendering a crocheted border for the piece of garment, it can also be used to weave in place the loose ends of the yarn. Just like knitting needles, crochet needles too, come in different sizes. Just so you do not choose the wrong one, we suggest that you opt for the thicker variety that will allow you to work on the yarn with ease.
Tapestry needles like crochet hooks help to weave in the loose ends. They are basically blunt and thick needles that are used to sew together two pieces of the garment. These needles have large eyelets so as to allow the yarn to pass through easily. Plastic needles are better if you are going to be knitting with children, while metal needles are always a better choice.
Crafting scissors or cutters are needed to cut off excess yarn from your project. Keeping a couple of matching spools is especially beneficial to sew two separate pieces together or to attach a loose end to the garment.
While knitting, you ought to keep your sewing kit handy. Sewing tools along with pins, stitch holders, stitch markers, and knit checkers are essential while knitting. Stitch markers and holders are needed to keep a record of the number of stitches and prevent them from slipping from the needle when not in use, respectively.
The best way to keep your work in optimum shape is to place it in a basket away from dust, pets, and children. Besides, a basket will allow you to store your needles, yarn, and woven fabric all in one place. It will also make it easier for you to carry along while traveling or moving around from one room to another.
Colorful yarns, needles, and knit books are all you need to start knitting. When you take it up, ensure you do not go overboard with the supplies; instead stick to the bare minimal. You can always head to the store later to purchase the same shade of yarn in case you run out of knitting yarn.

Somewhat inexplicably, I got the chance to spend a few days testing out the new Apple Watch.
If you’re looking for deep reviews of the technology or extensive rundowns of the features, there are plenty of places you can look. At the end of the day, I’m a pretty normal guy and I wanted to look the watch from that context. Is this a product that a slightly tech-savvy “average” person would find useful?
The Bottom Line (First)
So what does the Apple Watch cost? Like all Apple product lines, there are several options designed to suck the maximum amount of disposable income out of every pocketbook. A basic aluminum Apple Watch Sport starts at about $350, a stainless-steel edition starts around $550 and the penis-envy Gold Apple Watch edition costs between $10,000 and $17,000. Of course, the irony of a $10,000 watch is that anyone rich enough to afford one probably already has someone who answers their phone and emails.
You’ve Got The Look
Like most recent Apple products, the Apple Watch’s form and look is light years better than the competition. If you’re one of the unfortunate souls who purchased an Android-based smart watch, then you’ll be insanely jealous of the compact sleekness of the Apple Watch.
It’s small enough to look like a slightly larger-than-normal watch and there are multiple screens you can use to adopt the default watch face to your needs. You can swap out the watch bands easily, with some of the bands using a magnetic lock to attach themselves to the watch. On the downside, most of the watchbands will run you $100-$300, so most people aren’t going to accumulate one for every outfit.
About That Phone
Like all current smart watches, the Apple Watch serves as a gatekeeper for your phone. Which means that in order to use an Apple Watch, you’ll need an iPhone. Specifically, an iPhone 5. The watch is slightly thicker than you might expect, but even the slightly heavier 42-millimeter version of the Apple Watch feels “right.” The retina display is sharp and there are a couple of different ways to navigate through the screens. You can tap and swipe, but there is also a “digital crown,” which really just looks the standard winder on a mechanical watch. You can use the crown to scroll and zoom, but I found myself just swiping for most tasks.
Steep Learning Curve
Unlike an iPad, Apple’s Watch doesn’t come out of the box ready to easily use. To get the most out of the watch and its features, you’re going to need to configure it to your needs. And that requires a several day learning curve that can be daunting even for the most tech-savvy person. One of the watch’s most useful features is to notify you when you’ve received an important email or text. But teaching your watch (via your phone) to screen your emails is a lot more work than it probably should be. However, once it’s set up, it’s an incredibly useful feature. Rather than pulling out your phone every couple of minutes, you can casually glance at your watch to see if that important email has arrived.
(Thump) You Have Mail
One of the coolest features of the Apple Watch is the way that it notifies you that an important email or text has arrived. The watch more or less lightly thumps you on the wrist. It’s a little difficult to describe the sensation and the first few times it happens, it’s a bit disconcerting. But you quickly get used to it and once you do, it’s an elegant and subtle notification method.
Your Apple Watch Wants To Pump You Up
Much has been made of the Apple Watch’s potential use as a fitness tracker and it’s true that feature is one of the ones most helpful out of the box. The watch uses a series of sensors to track all of the stats you’d expect to see in any fitness tracker. The watch will even remind you to get up and walk around if you’ve been sitting down too long. But there are issues, primarily due to the battery life. Since you’ll have to charge it at night, you can’t use the watch’s fitness functions to track your sleeping habits like you can with most higher-end fitness bands. Depending on the person, that may or may not be a factor.
About That Battery
Apple claims their new watches will hold a charge for 18 hours and as always, that depends on how much you’re using it. My experience is that the charge lasts longer, often close to 24 hours. You charge the watch via a magnetized inductive charging cable that clips to the back. It takes about 2 1/2 hours to fully recharge the phone, which you won’t notice if you’re doing it while you sleep.
Creepy Is As Creepy Does
One of the most practical uses for the watch is using it to interact with iMessage. The Apple Watch offers up a bunch of new animated emojis and scribbles you can use in iMessage.
For me, a lot of them seemed creepy and pointless. But maybe I’m just not the target audience for this feature. And I won’t even get into the odd feature that allows you to send a copy of your heartbeat to another user. It’s intimate and strange in an uncomfortable way and it’s difficult to see who would use it and why.
Phone Home, Dick Tracy Style
The Apple Watch has a built-in microphone and speaker, so you can make and receive phone calls. Okay, technically, you’re making the calls through your Bluetooth-connected iPhone.
The sound quality is fine, but unless you want to look a bit insane, you’ll probably want to talk on the phone using a Bluetooth headset.
Some Other Goodies
You can use your watch to pay for at the cash register using Apple Pay. Well, at least at the stores that use Apple Pay. But it does work well and it’s a pretty seamless experience.
There is also a feature called “Passbook,” which lets you digitally display your boarding pass. My experience is that it’s a clumsy way to do it and it’s probably easier in most cases to just use a printed copy.
The Downsides
Some of the downsides of the Apple Watch are related to the fact that this is Apple’s first product in the line and not everything is quite where it needs to be quite yet. While the Apple Watch native apps work great, the third-party apps range from useless to annoying. But I expect that to change quickly as the market expands. And while you can use Apple’s virtual assistant Siri with the Apple Watch, asking it for anything other than basic help with the watch results in an answer asking you to use the phone directly.
The other big complaint is that the Apple Watch can be slow. Sometimes maddeningly so. You can almost always do things quicker with your phone or laptop, so then it gets down to whether you think the convenience of completing the task on your wrist makes up for the fact that it will probably take twice as long.
So Should You Buy One?
If you’re a hardcore gadget geek or fan of everything Apple, you’re probably going to pre-order one. And it’s not a waste of money. You will use the Apple Watch and for some it is probably a great accessory. But at the end of it all, the Apple Watch is just a high-powered accessory to your iPhone. And if you don’t need that, then it probably makes sense to wait a Watch generation or two before you fork over a few hundred dollars.
At least the Apple Watch can be a practical gadget, unlike the aggressively pointless Google Glass.
